Roanoke Concrete Permit Guide: Patios, Driveways, Sidewalks, ROW Work, Land Disturbance, and Inspections

Before You Start: City Permits Do Not Replace Private Approvals
A Roanoke City permit does not satisfy any approval required by your homeowners association, condominium association, landlord, property management company, lease, deed, CC&R, or Architectural Review Committee. These private rules operate independently of the City permit process. If your property is subject to any of these requirements, secure those approvals before starting City permitting or authorizing contractor work.

Check with the City of Roanoke before starting work if any of the following apply to your project:
- You are pouring, replacing, or expanding a driveway, patio, sidewalk, or parking area on private property.
- Your driveway will connect to a public street, or any part of the project involves a public sidewalk, utility connection, or anything within the public right-of-way.
- The ground area to be disturbed is 2,500 square feet or more.
- Your project includes a retaining wall, particularly one with more than two feet of unbalanced fill.
- Concrete work is part of a broader project that also involves electrical, plumbing, or mechanical trade work.
- Your property is in a historic district or Neighborhood Design District.
- You are unsure whether any portion of the project touches City right-of-way.

Official sources do not publish a blanket “no permit required” rule for all concrete patios, private driveways, private sidewalks, slabs, or hardscape repairs in Roanoke. Always confirm with the City before assuming a project is exempt ROA-PATIO-DRIVEWAY, ROA-ROW-EXCAVATION, ROA-LAND-DISTURBANCE.
Private-Property Hardscape: Patios, Driveways, Sidewalks, and Parking Areas
Roanoke’s patio/driveway/sidewalk/parking project page covers hardscape features on private property, including patios, driveways, sidewalks, outdoor tennis courts, and parking areas ROA-PATIO-DRIVEWAY. The permit path depends on how much ground area will be disturbed.
Under 2,500 sq. ft. disturbed area. Roanoke lists a Zoning and Basic Development Plan Application and a Basic Development Plan, with possible additional items for properties in a floodplain or historic district. Zoning review runs 10 business days from a complete application. The zoning permit fee is $25. The zoning permit expires in 6 months ROA-PATIO-DRIVEWAY, ROA-FEES.
2,500 sq. ft. or more of disturbed area. Roanoke’s page directs these projects to the Comprehensive Development Plan and Land Disturbance Permit process rather than the basic hardscape path ROA-PATIO-DRIVEWAY, ROA-LAND-DISTURBANCE. The Land Disturbance process is described in its own section below.
If your hardscape project includes a driveway connecting to a public street, or any work within the public right-of-way, a Right-of-Way Excavation Permit is also required — in addition to any private-property zoning permit ROA-PATIO-DRIVEWAY, ROA-ROW-EXCAVATION.
Right-of-Way Excavation: Driveway Connections, Public Sidewalks, and Utility Work
Any work within Roanoke’s public right-of-way requires a Right-of-Way Excavation Permit. This includes driveway connections to the right-of-way, sidewalk installation, and utility connections ROA-ROW-EXCAVATION.
The application must be submitted by the contractor performing the work, not the property owner. Before the City accepts the application, the contractor must have approved bonding and liability insurance on file with the Transportation Division ROA-ROW-EXCAVATION. This is a condition of application acceptance, not something to arrange after submission.
ROW Excavation fees are $50 for a 30-day permit or $100 for a 60-day permit. Projects requiring a longer duration need Transportation Division approval ROA-ROW-EXCAVATION, ROA-FEES. Once ROW work is installed, the permit remains in issued status for two years, and the City conducts a warranty inspection before releasing permit surety ROA-ROW-EXCAVATION.
Land Disturbance and Stormwater: The 2,500-Square-Foot Threshold
When a concrete or hardscape project disturbs 2,500 square feet or more of ground, Roanoke requires a Land Disturbance Permit unless an exemption applies. When a Land Disturbance Permit is required, the City issues it before the related zoning or building permit ROA-LAND-DISTURBANCE.
Submission requires a completed application and a Responsible Land Disturber registered with the Virginia Department of Environmental Quality. If grading will disturb 1 acre or more, DEQ Construction General Permit coverage is also required ROA-LAND-DISTURBANCE.
Fees include an ESC plan review fee of $100 plus $50 per disturbed acre. Additional City and DEQ fee categories apply by acreage, and a $150 ESC inspection fee applies to single-family residences not part of a subdivision ROA-LAND-DISTURBANCE, ROA-FEES. Always confirm current amounts on the City’s Fees page before submitting ROA-FEES.
Development inspectors visit active land disturbance sites at least once every two weeks. New storm drains or BMPs require a called inspection. The permit does not close until the disturbed area is stabilized and a Notice of Termination is filed with the applicable general permit ROA-LAND-DISTURBANCE.
Structural Concrete, Retaining Walls, Building Permits, and Inspections
Retaining walls. Roanoke’s requirements depend on unbalanced fill height. A wall with less than 2 feet of unbalanced fill uses the zoning and Basic Development Plan path. A wall with more than 2 feet of unbalanced fill requires a residential or commercial building and zoning permit application ROA-RETAINING-WALL. Walls over 2 feet may also require an ESC plan if the associated disturbed area is 2,000 square feet or more, and higher walls can trigger building plan and design professional requirements ROA-RETAINING-WALL.
Review timing for retaining walls over 2 feet is 10 business days for zoning, plus 5 business days for single/two-family residential building review or 10 business days for other building types ROA-RETAINING-WALL.
Structural slabs, foundations, and remodel-repair situations. When concrete work is part of a project that includes building work and at least one trade — electrical, plumbing, or mechanical — Roanoke issues a combination building permit under its Remodel/Repair path. A general contractor must obtain that permit and list subcontractors. Plans may be required depending on scope ROA-REMODEL-REPAIR. Review is 5 business days for single/two-family residential projects and 10 business days for other building types, assuming a complete application ROA-REMODEL-REPAIR.
Permit activity and expiration. Permits expire if approved work is not started within 6 months of issuance or if no staff activity or inspection occurs within any 6-month period. No work or inspections should take place under an expired permit ROA-INSPECTIONS, ROA-SINGLE-TWO-FAMILY.
Inspection scheduling. Most Roanoke permits require at least one inspection. Requests submitted before 4 p.m. are scheduled for the following business day; requests submitted after 4 p.m. go to the second working day. Scheduling is available through eTRAKiT or by IVR phone at 540-208-5431 ROA-INSPECTIONS.
Before-pour coordination. If your project involves footings, foundations, or water and sewer lines, coordinate with your assigned inspector before pouring or covering that work. Roanoke gives these inspection requests priority to assist with pours and open excavations ROA-INSPECTIONS. Do not pour or cover until the required inspection is complete.
Fees and Timing
Always use Roanoke’s current Fees page for fee amounts ROA-FEES. Project pages may contain older fee tables; the consolidated Fees page is the current authority.
Key fees at the time of research (effective July 1, 2023):
- Zoning permit / Basic Development Plan: $25 ROA-FEES
- Construction permits: Start at $50 for up to $1,000 of estimated construction cost, plus $6.57 per additional $1,000; a 2% state levy applies to the permit fee ROA-FEES
- Building plan review: 10% of the building permit fee ROA-FEES
- ROW Excavation: $50 for 30 days; $100 for 60 days ROA-ROW-EXCAVATION, ROA-FEES
- ESC / Land Disturbance plan review: $100 plus $50 per disturbed acre, with additional categories by acreage ROA-LAND-DISTURBANCE, ROA-FEES
- Reinspection or off-hours inspection: $100 with a two-hour minimum ROA-FEES
Work without a permit. The City’s fee schedule provides for a penalty of two times the calculated permit fees for work performed without a required permit ROA-FEES. This is a penalty structure, not an alternative to compliance. Where a permit is required, it must be obtained before work begins. Fees change; confirm current amounts with the City before submitting.
State Building Code and Contractor Licensing
Roanoke enforces the Virginia Uniform Statewide Building Code, which provides the statewide building-code framework applied locally by the City’s building department VA-USBC-DHCD. Some project pages on the City’s website may reference a specific code edition. Confirm the current applicable edition with the Permit Center rather than relying on those older page references.
Virginia contractor licensing is administered through the Department of Professional and Occupational Regulation. Contractor licenses have classes and classifications, and DPOR provides license lookup and consumer resources at its Contractors Board page VA-DPOR-CONTRACTORS.
Have Ready Before Calling or Requesting Bids
- Property address and owner or contact information

- Sketch or photos of the proposed work area
- Estimated dimensions and square footage of the finished project
- Estimated square footage of ground area to be disturbed

- Basic Development Plan details, if a plan is required for your project type

Contractor and Owner Responsibility: Who Handles What
Concrete projects can involve multiple permit submissions, and the responsible party varies by permit type.
ROW Excavation Permit: The contractor performing the work must submit the application and must have approved bonding and liability insurance on file before the City accepts the application ROA-ROW-EXCAVATION. The property owner cannot submit this application on the contractor’s behalf.
Private-property zoning or building permit: Confirm with the Permit Center who the required applicant is for your specific project type. Some combination permits require a licensed general contractor to be the permit holder.
Permit fees: Fees are paid at application or as required by the permit process. Confirm timing with the City before submitting ROA-FEES.
Inspection scheduling: Inspections can be requested through eTRAKiT or IVR. Confirm who is responsible for scheduling — the permit holder, contractor, or homeowner — at the time of permit issuance ROA-INSPECTIONS.
Priority pour inspections: Whoever holds the permit should coordinate with the assigned inspector before covering footings, foundations, or water and sewer lines ROA-INSPECTIONS.
Land Disturbance / RLD / DEQ items: The applicant must provide a Responsible Land Disturber registered with DEQ and handle CGP coverage when grading exceeds 1 acre ROA-LAND-DISTURBANCE.
Permit closeout: For land disturbance projects, the permit holder is responsible for achieving site stabilization and filing the Notice of Termination with the applicable general permit ROA-LAND-DISTURBANCE.
HOA, Condo, Lease, and Deed Restrictions
A City of Roanoke permit does not satisfy any approval required by your homeowners association, condominium association, landlord, property management company, lease, deed, CC&R, or Architectural Review Committee.
